By using Apartmentcator — whether as a renter, licensed agent, or community partner — you agree to these terms. Please read them carefully.
Last updated: April 16, 2026By accessing or using the Apartmentcator website (apartmentcator.com), agent platform (app.apartmentcator.com), or any related services, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, do not use our services. Use of our services constitutes acceptance of these Terms in their entirety.
These Terms apply to all users of Apartmentcator, including renters seeking apartment locating services, licensed real estate sales associates using the agent platform, and apartment community partners listing with us.
Apartmentcator provides the following services:
Apartmentcator acts as a connecting platform. We are not a party to any lease agreement between a renter and an apartment community, nor are we a party to any referral fee agreement between an agent and a community.
Apartment locating through Apartmentcator is provided at no cost to renters. Apartmentcator is compensated by apartment communities when a renter successfully leases a unit through our service. You will never be charged a fee for using our locating service.
By submitting a search request, you consent to being contacted by Apartmentcator and our licensed locators by phone, email, and/or text message regarding your apartment search. Standard messaging rates may apply. You may opt out at any time.
You agree to provide accurate and complete information in your search request. Providing false information — including inflated income, false credit scores, or misrepresentation of household composition — may result in removal from our service and potential liability if it causes harm to a community or locator.
We make no guarantee that we will be able to find an apartment that meets your criteria, that specific communities will have availability, or that you will be approved for any particular apartment. Our service is best-effort matching based on the information you provide and the communities available in our network at the time of your request.
Final approval for any apartment lease is solely at the discretion of the apartment community. Apartmentcator has no authority to guarantee, override, or influence a community's leasing decision, credit approval, or income qualification requirements.
To register as an agent on Apartmentcator, you must hold an active, valid real estate sales associate license in good standing in Florida or Georgia. Your license must be held under an active sponsoring broker. By registering, you represent and warrant that you meet these requirements and will notify us immediately if your license status changes.
By submitting your registration, you authorize Apartmentcator to verify your license information with the applicable state licensing board — Florida: myfloridalicense.com; Georgia: grec.state.ga.us. False or fraudulent license information will result in immediate termination and may be reported to the applicable licensing authority.
As a registered agent, you agree to:
Access to the full Apartmentcator agent database requires a paid subscription. Subscription fees are billed monthly and are non-refundable except as required by law. Apartmentcator reserves the right to change subscription pricing with 30 days advance notice. Continued use after the effective date of a price change constitutes acceptance of the new pricing.
Agents registered with RCA Realty Group as an active sponsoring broker receive complimentary platform access as a brokerage benefit. This benefit may be modified or discontinued at any time with 30 days notice.
Apartmentcator facilitates the introduction between agents and communities but is not a party to referral fee agreements. We do not guarantee payment of any referral fee by any community. Disputes regarding referral fee payment are between the agent and the community. We will make reasonable efforts to facilitate communication in disputed cases but are not liable for unpaid referral fees.
Agents are independent contractors and are solely responsible for reporting and paying all applicable taxes on referral income. Apartmentcator will issue a 1099-MISC for payments facilitated through our platform that exceed $600 in a calendar year, as required by IRS regulations.
Community partners agree to provide accurate information about their communities, including current rent ranges, availability, referral fees, leasing contact information, and any requirements for referral fee payment. You agree to notify us promptly of any material changes to this information.
By listing on Apartmentcator with a posted referral fee, you commit to honoring that fee to any registered Apartmentcator agent who submits a valid guest card and whose referred client subsequently signs a lease, subject to the terms of your posted compensation schedule. Repeatedly failing to honor posted referral fees may result in removal from the platform and a negative rating in the agent database.
All referral fee payments are made directly from the apartment community to the referring agent. Apartmentcator does not handle, process, or guarantee these payments. The listing fee paid to Apartmentcator is separate from and in addition to any referral fees owed to agents.
Community partner listing fees are billed per our current pricing schedule. Fees are non-refundable after your listing has been activated. Apartmentcator reserves the right to modify listing fees with 30 days advance notice. Annual subscribers will not be subject to mid-term price changes.
By submitting photos, descriptions, floor plan links, and other content to Apartmentcator, you grant us a non-exclusive, royalty-free license to display that content in the agent database, our website, and marketing materials for the duration of your active listing.
Apartmentcator reserves the right to remove any community listing at any time for violations of these Terms, including but not limited to: failure to honor posted referral fees, providing false information, or conduct that harms our agents or renters.
This is the most important policy for agents and communities to understand. Read it carefully before submitting any guest cards or listing on the platform.
A guest card is a timestamped submission made by a registered Apartmentcator agent through the agent portal prior to a client's first visit to an apartment community. It registers the agent's referral claim for that client at that community.
In the event of a guest card dispute, the timestamp in the Apartmentcator system is considered the authoritative record. Apartmentcator will provide this timestamp to both parties upon request but takes no further adjudicatory role in payment disputes.
All payments to Apartmentcator (agent subscriptions and community partner listing fees) are processed through Stripe. By providing payment information, you authorize Apartmentcator to charge your payment method for the applicable fees.
Subscription fees are billed monthly in advance and renew automatically until cancelled. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time in a billing period.
If a payment fails, we will attempt to retry the charge. After multiple failed attempts, your access may be suspended until payment is resolved.
Apartmentcator does not process, hold, or facilitate referral fee payments between agents and apartment communities. Those payments are solely between the referring agent and the apartment community.
You agree not to:
Violations of these prohibitions may result in immediate termination of your account and, where applicable, reporting to state licensing authorities.
The Apartmentcator name, logo, website design, agent database structure, and all related content are the intellectual property of Apartmentcator and its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or proprietary content without our express written permission.
Community partners retain ownership of their photos and descriptions but grant us a license to display them as described in Section 5.
Apartmentcator provides its services "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
To the maximum extent permitted by applicable law, Apartmentcator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to lost referral fees, lost lease opportunities, or reliance on inaccurate listing data.
Our total liability for any claim arising from your use of Apartmentcator shall not exceed the amount you paid us in the 12 months preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. For significant changes, we will provide notice via email to registered users at least 14 days before the changes take effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
